The  MAW Report

Hi All,
     I thought I would pass along the final version of the sentencing guidelines that will be submitted to the Bench on Tuesday.  This is the result of all of you who stood on the sidewalk last year asking for signatures and dealing with rejection.  We did good .  Tim Stoen of the D.A.’s office is one stand up guy, and we as a community are lucky to have someone like him.  If you see him around town, tell him thank you. We will show up on Tuesday (in yellow), and then we will have done all that we can do.  But we did Good !

DISTRICT ATTORNEY RECOMMENDATIONS ON ABALONE SENTENCES

 2013 SEASON

In response to the petition that was presented to the court by the Mendocino Abalone Watch,

and pursuant to Rule 4.102 of the California Rules of Court, the Mendocino County District Attorney’s Office makes the following sentencing recommendations for abalone violations occurring during the 2013 season:

1)      One abalone in violation:

a)      Base fine of $500, plus penalty assessment ($313.50)

b)      Probation: 12 months, no fishing, forfeiture of items seized, surrender of license, turn-in of abalone report card

c)       Community service: 8 hours — local,[1] or out of county with a natural resources agency

2)      Two abalone in violation:

a)      Base fine of $1,000, plus penalty assessment ($313.50)

b)      Probation: 12 months, as above

c)       Community service: 16 hours, local only

3)      Three abalone in violation:

a)      Base fine of $2,000, plus penalty assessment ($313.50)

b)      Probation: 12 months, as above

c)      Alternative choice: jail or community service:Jail:

i)        2 days, no SWAP; or

ii)       32 hours community service, local only

4)      Four abalone in violation:

a)      Base fine of $3,000, plus penalty assessment ($313.50)

b)      Probation: 12 months, as above

c)      Alternative choice: jail or community service:Jail:

i)        7 days, no SWAP; or

ii)       80 hours community service, local only

5)      Five abalone in violation:

a)      Base fine of $4,000, plus penalty assessment ($313.50)

b)      Probation: 24 months, with other above terms

c)       Alternative choice: jail or community service:

i)        Jail: 15 days, no SWAP; or

ii)       200 hours community service, local only

6)      Six to twelve abalone in violation:

a)      Base fine of $1,000 per abalone

b)      Probation: 24 months, with other above terms

c)       Alternative choice: jail or community service:

i)        Jail: 20 days for six to eight, 30 days for nine to twelve, no SWAP; or

ii)      250 hours community service, local only
